On July 13, 2026, during the 58th session of the Patent Cooperation Treaty (PCT) Assembly held in Geneva, the World Intellectual Property Organization (WIPO) formally approved the appointment of the Mexican Institute of Industrial Property (IMPI) as an International Searching Authority (ISA) and International Preliminary Examining Authority (IPEA) under the PCT.
With this appointment, IMPI becomes the 26th office worldwide authorized to act as both an ISA and an IPEA under the PCT, joining patent offices such as the European Patent Office (EPO), the United States Patent and Trademark Office (USPTO), the Japan Patent Office (JPO), and other leading patent offices. IMPI is expected to begin operating as an ISA/IPEA in January 2027.
In this new capacity as an ISA/IPEA, IMPI will be authorized to perform international searches and international preliminary examinations under the PCT, providing applicants with an additional option for the international phase of PCT applications.
This designation comes at a time when IMPI is implementing significant reforms to its domestic patent examination system, including shorter substantive examination timelines and a new examination procedure limiting substantive examination to two substantive office actions.
At OLIVARES, we will continue monitoring the implementation of IMPI's new role under the PCT and will keep our clients informed of further developments and their practical implications for PCT applications.
