OLIVARES has a reputation as one of the most recognized and prestigious firms in Mexico for having obtained favorable results in complex litigation that have also set precedents and criteria now followed by a significant number of companies listed in the FORTUNE Global 500. This experience allows OLIVARES to have a unique and better understanding of disputes arising between individuals, organizations, and authorities to reach an out-of-litigation solution, with a practical approach, taking into consideration future conflicts

Cross-border mediation and arbitration, the most common forms of alternative dispute resolution, can provide faster and less expensive solutions in Mexico than litigation in many circumstances. The experts at OLIVARES evaluate each situation to determine which process has the likelihood of offering the best outcome.

Partners of the firm have participated as arbitrators before WIPO and as mediators in a number of controversies in Mexico and abroad, including participation as intellectual property experts in international litigation and in the only NAFTA arbitration panel related to patent issues.

The experience of the firm and capacity includes the resolution of corporate conflicts, negotiations to resolve and conclude litigation, representation in arbitration proceedings, elaboration of arbitration and mediation clauses, and the implementation of dispute resolution strategies(Note on the Covid-19 effect on the courts… With judicial and administrative bodies facing unprecedented backlogs, OLIVARES recommends exhausting all opportunities for alternative dispute regulation ahead of pursuing litigation.)
